Welcome to the Cognitive IT Blends Scholar Transport PWA. By accessing, registering for, or subscribing to our platform through PayFast, you agree to these Terms and Conditions. Please read them carefully before using our services.

1. About Our Service

The Cognitive IT Blends Scholar Transport PWA is a digital platform designed to enhance the safety, efficiency, and management of learner transport services. Our platform provides features including learner and parent management, driver and vehicle management, live location tracking (where available), arrival notifications, compliance verification, reporting, digital attendance, QR code verification, biometric integration (where applicable), and other transport management services.

2. Registration

To use our services, you must provide accurate, complete, and up-to-date information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Cognitive IT Blends reserves the right to suspend or terminate accounts containing false, misleading, or fraudulent information.

3. Subscription & Payments

Access to certain services requires an active subscription. Payments are processed securely through PayFast, using the payment methods supported by the PayFast platform. Subscription fees are displayed in South African Rand (ZAR) and include VAT where applicable.

Where a recurring subscription is selected, your subscription will automatically renew on the applicable billing date until cancelled. It is your responsibility to ensure sufficient funds are available for recurring payments.

4. Cancellation

You may cancel your subscription at any time through your PayFast subscription settings or by contacting Cognitive IT Blends. Cancellation will stop future recurring payments; however, your access to the platform will remain active until the end of your current paid subscription period.

5. Refund Policy

Registration fees are non-refundable. Monthly or annual subscription fees are generally non-refundable once processed, except where required by South African law or where a duplicate payment, incorrect charge, or verified system error has occurred. Approved refunds will be processed within 10 business days.

6. User Responsibilities

By using the platform, you agree to:

• Provide accurate information at all times.
• Use the platform only for lawful purposes.
• Keep your login details secure.
• Ensure that all driver, vehicle, and learner information submitted is accurate and up to date.
• Comply with all applicable transport and road safety regulations.

Any misuse of the platform, including fraudulent activity, unauthorised access, or attempts to interfere with system operations, may result in immediate suspension or termination of your account.

7. Driver & Vehicle Compliance

Transport operators are responsible for ensuring that all drivers and vehicles registered on the platform comply with applicable South African legislation. This includes maintaining valid driver’s licences, Professional Driving Permits (PrDPs), vehicle licences, roadworthy certificates where applicable, and any other required documentation. Cognitive IT Blends may verify submitted information using authorised third-party verification services where available.

8. Platform Availability

We strive to provide uninterrupted access to our services; however, we cannot guarantee continuous availability. Temporary interruptions may occur due to scheduled maintenance, internet connectivity issues, third-party service providers, government verification systems, or circumstances beyond our reasonable control.

9. Third-Party Services

Our platform integrates with trusted third-party providers, including payment gateways, mapping services, messaging services, notification services, and verification providers. While we carefully select our partners, Cognitive IT Blends is not responsible for delays, outages, or failures caused by these external services.

10. Privacy & Protection of Personal Information

We are committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA). Personal information collected through the platform is used only for providing our services, verifying information, processing payments, communicating with users, improving our platform, and complying with legal obligations. We do not sell your personal information to third parties.

11. Intellectual Property

All software, source code, branding, logos, graphics, content, documentation, databases, and other intellectual property associated with the Cognitive IT Blends Scholar Transport PWA remain the exclusive property of Cognitive IT Blends (Pty) Ltd. No part of the platform may be copied, reproduced, modified, or distributed without our prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law, Cognitive IT Blends shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform, including service interruptions, GPS inaccuracies, internet failures, third-party system outages, or the actions of transport operators or drivers. Our total liability shall not exceed the subscription fees paid by the user during the preceding three months.

13. Changes to These Terms

We reserve the right to update or amend these Terms and Conditions at any time. Any changes will become effective upon publication on our website or within the Scholar Transport PWA. Continued use of the platform after changes have been published constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from the use of the platform shall be subject to the jurisdiction of the South African courts.
